Clear terms.
For everyone giving and receiving support.
Effective 5 November 2026.
These terms apply to atpesa accounts, support pages and support payments. Read them with the Privacy Policy and pricing explanation. Agreement is requested when signing up and before paying.
1. What atpesa does
atpesa gives people, teams and businesses a page to receive voluntary support. Support is a tip or expression of appreciation. Support pages must not offer shares, loans, profit participation, investment returns or raffle entries.
2. Who can use it
Account holders and people making payments must be at least 18 and able to enter a binding agreement. Anyone acting for a business or group must have authority to do so. Do not impersonate another person, misrepresent your work or create an account to evade a suspension.
3. Your account
Provide accurate account details. Keep your account secure and tell us promptly if you suspect unauthorized access. Before receiving live support, page owners must verify their identity and payout details. We request only the information needed for verification.
4. Fundraising claims and content
Identify who will receive the money and what it will be used for. Use funds for the purpose stated on your page. Get the beneficiary’s permission before raising money on their behalf, and obtain any approvals required by law. Correct material changes promptly and tell us if the appeal should close. You keep ownership of your content and give atpesa permission to display and share it to operate your page. Post or link to material you own or have permission to use. Get permission before sharing anyone’s private information.
5. Support and payment confirmation
Supporters can pay by M-Pesa or card without an account on atpesa. Our payment provider’s terms apply. Enter your M-Pesa PIN only in the official M-Pesa prompt. Check the payment status on atpesa before treating the payment as received. Only confirmed live payments count toward support totals.
6. Fees
atpesa charges a 5% platform fee on each confirmed support payment. The payment processing fee is deducted from the page owner’s remaining 95%. Taxes, refunds, disputes, reserves and any applicable additional provider charges may affect the final amount paid out. Page owners are responsible for any tax obligations that apply to their receipts. An atpesa receipt confirms a payment. Any tax deduction depends on applicable law.
7. Payouts
Eligible payouts go to the page owner’s verified account. The standard Kenyan payout schedule is two working days, subject to account terms, verification, holidays and provider restrictions. Payment confirmation and payout are separate. atpesa does not provide a bank account, an interest-bearing wallet or guaranteed instant access to funds.
8. Refunds and disputes
Check the page owner, amount and payment details before paying. Contact us promptly about duplicate, unauthorized or mistaken payments or a misleading appeal. Include your payment reference. We review refund requests and disputes with our payment provider, and page owners must cooperate with those reviews. Refunds and payment reversals can reduce the amount a page owner receives. A change of mind does not automatically qualify for a refund. Your legal rights and dispute remedies still apply.
9. Integrity and prohibited activity
Do not use atpesa for fraud, money laundering, sanctions evasion, stolen payment instruments or other unlawful activity. Fake appeals, fabricated payments or endorsements, and misleading claims of charity status or tax deductibility are prohibited. We may investigate reports, request relevant proof of identity or authority, and restrict a page or pause payments where the law or payment provider’s terms permit.
10. Privacy and supporter choices
The Privacy Policy explains what information we collect, why we use it and who can see it. Supporters can hide their name from the public page. The support amount may still appear. Page owners must protect supporter information and use it only to administer support, resolve payment issues or send updates the supporter has requested. Page owners must honor unsubscribe requests and may not sell supporter information.
11. Suspension, closure and availability
Pages may be restricted or removed for misuse, infringement, security concerns or provider requirements. Contact us to request account closure; payment, dispute and audit records may still need to be retained. Closing an account does not erase outstanding obligations or reverse a verified payment. Service availability depends in part on networks and payment providers, and uninterrupted operation is not guaranteed.
12. Responsibility, reports and disputes
Page owners are responsible for their content, fundraising claims and promises. For a complaint, send the page link or payment reference and a description of the problem to hello@atpesa.com. For copyright reports, identify the work, the material at issue and the rights you hold or represent. We may restrict access while reviewing a report and follow the notice and counter-notice process where required by law. These Terms are governed by Kenyan law. Disputes that cannot be resolved directly may be taken to a competent Kenyan court or authority. All mandatory consumer rights, remedies and liabilities remain in effect.
13. Operator, changes and contact
Autosoft Shujaa operates atpesa. Updated terms apply going forward. We publish the effective date and ask for acceptance when required. Contact us about these terms at hello@atpesa.com.
